General

  1. In this policy, we wish to inform you about the types of personal information collected and the purposes for collecting personal information (as defined below) by BROTHERS AND SISTERS FOR ISRAEL – HAMAL EZRAHI (R.A.), a registered non-profit association number 580768935 (hereinafter: the "Association" or "we") regarding its activities and various services it provides to the public as detailed below and on the website: www.hamal.org.il or at another related address or as may be updated from time to time (hereinafter together: the "Services" and the "Website" respectively).

  2. No legal requirement. We hereby inform you that you are under no legal obligation to provide the Association with personal information or any other information, and the provision of information is based solely on your free will. However, without providing the required personal information, we will not be able to provide the Services in part or in full, as applicable.

  3. By using the Association's Website and Services, including in the context of volunteering for various services, you knowingly confirm and agree: (1) to the collection and processing of personal information by the Association (including any transfer of information to third parties, subject to the details in the Privacy Policy below) for and in accordance with the purposes detailed below in this Privacy Policy; (2) the personal information is yours or about a family member, and if you provide us with information regarding a related third party, you have the legal right to provide it to us, and the information you provide is complete, accurate, and truthful.

  4. This policy is written in the masculine form for convenience only but applies equally to all genders.

Association Services and Purposes of Personal Information Collection (hereinafter: “the Purposes”)

The personal information (as defined below) that will be collected by the Association and its representatives will be used for the purpose of performing, operating, and providing the Services, complying with legal provisions, and protecting the legitimate interests of the Association, as well as in connection with the following purposes (all or part of them, as necessary, according to the circumstances and the referral to the Association):

  1. For purposes of control and information security of the Website and its use, such as detecting and preventing fraud, abuse, or other illegal activities; to meet legal requirements and regulatory obligations, including in connection with legal proceedings, authority orders, etc.; for establishing and defending legal rights; for the purpose of investigating and resolving complaints and handling requests to review or correct information; in order to protect our activities, our rights, privacy, security or property, ours and/or of companies associated with us; and to enable us to assert our rights to remedies or to mitigate our damages.

  2. To create aggregate or anonymous data from personal information provided by you or collected by us in connection with your use of the Website. The data we create from personal information will be used to improve the Website and/or user experience, evaluate how users use the Website, as well as for managing the Website, its operation, fixing malfunctions, and security.

  3. For the purpose of transferring information to third parties as detailed in section 9 below and for any other legitimate purpose permitted to us by law.

  4. Volunteer management and recruitment – Registration, sorting, placement, volunteer retention, training and instruction, insurance, invitation to appreciation events, communication, and updates.

  5. Management of assistance requests for beneficiaries – Receiving inquiries, needs assessment, resource allocation, coordination of assistance actions, and process documentation.

  6. Partner relationship management – Contacting non-profit Associations, authorities, government ministries, and Associations, coordinating and managing projects, monitoring activities, and producing reports.

  7. Donation management – Issuing receipts, managing donor registry, canceling standing orders, meeting reporting requirements under the Non-Profit Associations Law, and responding to inquiries.

  8. Control and regulatory compliance – Reporting to authorities, maintaining information security and privacy procedures, conducting risk assessments, and adhering to relevant legal requirements.

  9. General uses of the Website and Services – Operation and management of the Website, operation of public relations system, mailings and notifications, prevention of fraud and abuse, information security, improving user experience.

What Personal Information Will Be Collected by the Association?

In this policy, "personal information" means "information" and "information of special sensitivity" as defined in the Privacy Protection Law, 5741-1981, and the regulations enacted thereunder, as well as information that identifies or may identify you personally, including identifying personal information that will be provided to the Association, including:

Contact details, such as first and last name, residential address, email address, telephone numbers, ID number, audio and video recordings, photos, financial information related to donations or financial needs, as well as any identifying information you provide to Association representatives as part of your referral to the Association or in the continued handling of your inquiry, including recordings of conversations with various representatives of the Association in various services, as well as identifying information you provide through the Website and/or collected on the Website and in the Association's various communication channels, including conversations, messages, and WhatsApp groups.

 

Information Regarding Donations:

When making a donation through one or more of the Association's Services, you may be required to provide additional personal information as well as credit card details. Adding credit card details is done by clicking on a button that leads directly to the payment processor's website. For more information, please read the terms of use and privacy policy of the payment processor. It is emphasized that the Association does not collect and/or store the user's credit card details. It is clarified that the Association is not responsible for the acts and/or omissions of the payment processor, and the use of the payment processor's services is solely your responsibility.

 

In addition, information about your use of the Website will be collected:

Details about your visits to the Website, including information collected through Cookies necessary for the operation of the Website, Internet Protocol (IP) address and your domain name, device location data, information about your visit and use, through the Website and from it (including in certain required cases, identifying mobile phone location), other communication data on the resources that you and those on your behalf access and use. For details about the use of monitoring tools and Cookies, see section 11 below.

Sources and Methods of Information Collection by the Association

The Association collects personal information for the purposes defined in section 5, in several ways and channels managed by it through the following sources:

  1. From users of the Website, conversations, messages, and WhatsApp groups;

  2. Directly from you when you provide personal information to the Association for various purposes (and to various centers, including activity at the Northern Logistics Center), and to its representatives in the context of submitting an application for volunteering, providing or receiving assistance, including by telephone, at the Association's centers, registration for the Association's Services, engagements with you and contact for updates;

  3. Through joining various WhatsApp groups that concentrate and transfer information to the Association and those on its behalf; as well as direct communication (conversations) on WhatsApp.

  4. Through forms you filled out manually or in an online form of the Association or on its behalf.

  5. Information may be provided by third parties (including family members, employers, as part of collaborations, etc.), non-profit Associations, volunteers, citizens, as well as state authorities, Israel Police, IDF, MDA, etc.

Use of Information

  1. The Association may process and use personal information to promote the Purposes and to contact you for the operation of the Association and the Purposes.

  2. The personal information will be used to improve, enrich, or change the services and content offered by the Association, on the Website, in order to streamline and manage the relationship with you and those on your behalf as needed, for conducting surveys and questionnaires related to the Association's purposes.

  3. The Association may send you notices and alerts in various ways, including via email, text messages, or push notifications to your device, and through the contact details you provided for contact, such as various messages regarding the Association's activities, requests for participation and mobilization, volunteering, updates, and more.

  4. As part of the Services on the Website and in WhatsApp conversations and groups, various links to external websites and/or applications may appear, some of which may be uploaded by additional users in groups and are not under the control of the Association. Clicking on the link is done at your discretion and at your sole responsibility. Clicking on links takes you out of the Association's Website/WhatsApp groups and directs you to external website(s) or applications, and you will be subject to their terms, including their privacy policy. From that point on, the Association will have no control over what happens with your personal information, and therefore it will not bear any responsibility for it.

  5. In addition, the Association will be entitled to contact you, including by way of sending direct mailings, and to offer you various offers related to the Purposes or in connection with other initiatives with similar purposes via email, text messages, telephone, or other means, based on your details and personal information about you stored in the Association, provided that it is done in the context of the Purposes. No commercial use will be made of your personal information.

  6. You can request to remove your details from the distribution list of marketing communications by sending an email message titled "Removal Request" to the email address contact@hamal.org.il. Please do not send additional personal details via email.

Disclosure of Personal Information to Third Parties

The Association may be required to transfer personal information about you to third parties, from time to time in several cases, as detailed below, for the performance of the Purposes, and according to the requirements of authorities, including:

  1. To any person, corporation, body, authority, and governmental, public, private, or other entity, including the IDF, Israel Police, MDA, and those on their behalf, for the purpose of performing the Purposes and/or according to any provision in law that permits or requires the Association to do so;

  2. To subcontractors working on behalf of the Association, such as software providers, IT providers, cloud hosting service providers, digital media service providers for information sharing purposes for the performance of the Purposes;

  3. To Association representatives, volunteers, call center operators, and teams operating within the Association's Services, to other participants in WhatsApp groups, to logistics centers, communication channels, etc., for the purpose of performing the Purposes.

  4. Related non-profit Associations, initiatives, and companies: We may share information about you with non-profit Associations, initiatives, and companies related to the Association's purposes, in Israel or abroad, for the provision of Services, internal administrative needs, consulting, data analysis and quality control, research and development, and risk management.

  5. In any case where the Association believes that the disclosure of personal information is necessary to prevent harm to individuals, to the Association's purposes or activities, to the property or body of participants in the Association, including volunteers, or to prevent other serious harm according to the Association's discretion, subject to law;

  6. In any case where users violate the terms of use, including the terms of the privacy policy and/or in cases where actions are performed by you that are contrary to the terms of use, including the privacy policy, including violation of any legal provisions;

  7. For the purpose of investigating claims and managing proceedings and/or legal and/or statutory disputes, between you and/or anyone on your behalf and the Association and/or anyone on its behalf;

  8. The Association may provide anonymous statistical information to third parties, subject to the terms of this privacy policy. Statistical information that will be provided to third parties will not personally identify you.

  9. Nothing in the above shall derogate from the Association's right to transfer to third parties information that is not personal, which does not identify you.

  10. Subject to the provisions of law, the Association may transfer all personal information about you accumulated by it to a third party as part of the transfer or assignment of its activities (all or part of them) and/or reorganization, merger, joint ventures, and other transactions related to its activities (including as part of negotiations for such transactions) and for the purpose of continuing to provide the Services by the third party. All this is subject to the commitment of the recipient of the information to use the information in accordance with the limitations that apply to the Association.

Links to Third-Party Websites

The Website may include links to websites or platforms of external third parties for which we have no responsibility for the processing of personal information by them. If you choose to click on a link directing to an external website/platform, it is recommended to carefully read the privacy policy and terms of use of that third party. Cookies and Technological Tools

We use technological tracking tools such as cookie files. Cookies, in general, are tools that monitor your activity and automatically collect information about your browsing habits and technical information about your device. Some cookies will expire when you close the browser, and others are stored on your device or computer memory. Cookies can be permanent (will remain for a defined period or until deleted by the user) or session-dependent (deleted when use ends).

Information Security

The Association is a non-profit institution working to promote its public purposes, and therefore we note that reasonable efforts have been invested in the Website and Services, as far as possible under the circumstances, to work to protect the confidentiality of personal information provided to the Association and those on its behalf, this while taking precautionary measures and using security technologies aimed at helping to protect against information leakage, unauthorized access and use, as well as against transfer, exposure, copying, and deletion of information.

We note that given the circumstances in which the Association operates, it is understood that the Association cannot fully secure and completely prevent the existing risks to information security, some of which are not under its control, so that it cannot be guaranteed that the Website and the Association's databases will be absolutely immune to these actions, and the Association will not have any responsibility for any damage caused as a result.

Users, volunteers, and anyone who operates and uses the Association's Services are aware that there is always a certain risk in services based on information processing, especially when transmitted over the Internet, in WhatsApp groups, and other communication channels, and hereby agree to the provision and collection of information in accordance with the privacy policy and the law and assume the risk of information security incidents which may affect the confidentiality, integrity, or availability of such information.

In addition, every volunteer, Website user, and active participant in the Association has a personal responsibility to keep confidential and not share the personal information to which they are exposed in the context of participation in the Services and access to the Association, to avoid giving access to personal information and/or to the computer/personal equipment on which it is stored to unauthorized entities, and not to share password details, username, and email to unauthorized entities.

The responsibility to take information security measures also applies to you, for example:

  • Do not provide identification details to another (for example, by email), to protect against online fraud ("phishing").

  • Make sure that the contact details you provided to us (including phone number and email address) are correct.

  • Use means against viruses, computer intrusion, etc. on your end equipment from which you browse the Website.

  • Take care to update software, download from official websites, encrypt, avoid using public computers or public WIFI networks, not share sensitive information on social networks.

  • Adapt the way you contact us to its content. For example, if you do not use encryption mechanisms and electronic and secure signatures, it is advisable not to contact us via email if it is a sensitive matter concerning you.

  • If you are concerned that information about you has reached an unauthorized third party, contact us immediately.

International Data Transfers

The personal information you provide will be stored in the Association's databases and processed by it and by third parties on its behalf. We may store, keep, process, or transfer information to various sites around the world outside of Israel, including through cloud service providers. It is possible that in these places the level of protection of personal information is less than that in Israel. By using the Services, you consent to such use, processing, transfer, storage, or retention of information in countries outside of Israel. If specific legal requirements apply to us regarding data transfers, we will work to ensure that the transfer of personal information is done in a manner that complies with legal requirements.

Retention of Personal Information

We store different types of information for different periods, according to the purposes of collecting the information, the legitimate interests of the Association, as well as in accordance with the requirements of privacy laws under applicable law.

We also retain personal information as long as the Services are being used and for the purposes of performing the Purposes (as applicable) and/or as long as there is a vital need to retain the personal information, including for the purposes of documenting the Association's activities, for managing information security, legal proceedings, and tax matters. Some of a user's personal information may be retained even after the use of the Services has ceased, for the period of time required of us by law (for example, by law enforcement authorities, Israel Police, IDF, specific laws and regulations for the Services, for bookkeeping purposes or managing legal proceedings). Thus, information necessary for the Association to manage its activities, including documentation of actions you performed in connection with the Services or for the purpose of continuing to provide the Services in the future, will continue to be stored with us according to law.

Unless the law provides otherwise, non-identifiable information will be kept for an unlimited period.

Rights

Subject to the provisions of law, you have the right to review information about you, which is in the Association's databases, and even to request the Association to delete or correct this information if it is not correct, complete, or accurate. This right can be exercised, and any question or clarification regarding this policy can be addressed through the Association's "Contact Us," and reasonable efforts will be made to fulfill these requests, in accordance with the provisions of the law.

You have the right to cancel your consent to receive mailings from the Association by following the instructions and the unsubscribe link in the mailing sent to you from us. Or by contacting us at the contact address below.

We note that a request to review, correct, and delete information will be made subject to the provisions of law (for example, in the case of a donation, tax authorities may require information).

Jurisdiction and Applicable Law

Only the laws of the State of Israel will apply in the enforcement of this privacy policy.

Changes to the Privacy Policy

We may update this privacy policy from time to time. In the event the policy is updated, we will publish the new policy on the Website along with a notice of the changes. The updated policy will apply from the moment of its publication and according to the last update date appearing under the title above. Each version of the privacy policy will be marked at the top of the document with its effective date. Continued use of the Services after such policy update will be considered on your part as consent to the update(s) made.
